When Travcour’s services are used by a Travel Agent on behalf of one or more clients, the Agent acknowledges and agrees that Travcour contracts solely with the Agent as principal and Travcour shall have no personal liability to any client of the Agent. The Agent agrees to indemnify Travcour against all claims of any kind whatsoever, howsoever caused or arising brought by any client of the Agent in relation to any act or omission by Travcour or its agents and employees in connection with undertaking or performing any Visa Processing or Advisory Services for or at the request of the Agent.
Under no circumstances shall Travcour be liable for consequential loss or damage however caused or arising.
The Agent acknowledges and agrees that Travcour’s services are or will be acquired in connection with its Travel Agency business and that the provisions of the Consumer Guarantees Act 1993 are excluded and shall not apply to the Visa Processing and Advisory Services which Travcour undertakes or performs for or at the request of the Agent.
Payment of accounts is required by the 20th of the following month. Travcour reserves the right to withhold any services when an account is in arrears and only release documents when any arrears are paid in full. Should payment problems persist, the account will remain on a stop credit basis permanently and all future transactions will need to be conducted on a cash sales basis only. Any debt collecting fees will be the responsibility of the customer.
These Terms & Conditions are Travcour’s intellectual property. No part of our website can be replicated without our written consent.
Travcour reserves the right to amend/add/remove any Terms & Conditions without notice. Use of our services is deemed such amendments are agreed to. Terms & Conditions are governed by and construed by the laws of New Zealand.
VISA ADVISORY SERVICE
Travcour will endeavour to provide the most accurate Visa Advice available.
However, Travcour will not be held responsible for information supplied by Embassies or Consulates, IATA publications (TIM/TIMATIC), or any other source which transpires to be incorrect or inaccurate.
Due to ever changing visa regulations, Travcour will not be held responsible for information which subsequently becomes incorrect.
In the unlikely event of a dispute regarding the accuracy or validity of any advice given by Travcour, only advice or information in a documentary form will be considered when resolving the dispute Travcour’s maximum liability for incorrect or incomplete visa advice is NZ$500.
The sharing of allocated Travcour website pin numbers with those not employed by the Visa Advisory Subscriber and Brokers directly connected with the same branch will result in the termination of access and possible legal action. Not all information can be stored on our website. The content of our website is provided in good faith and based on our interpretation of information supplied. Subsequently, no liability will be accepted for omissions or inaccuracies or consequences of using Travcour’s website. Content of links to external websites can also not be guaranteed.
VISA AND PASSPORT PROCESSING SERVICE
Travcour will endeavour to process visas and passports in the shortest time possible whilst utilising the most reliable and secure methods of transport available to and from Embassies and Consulates.
It is acknowledged that in order to provide its services, Travcour must engage the services of third parties whose Terms & Conditions we are bound by.
Whilst every reasonable effort will be made to obtain the required visas or passports within the time frame given, Travcour will not be held responsible for delays caused by or due to processing times or procedures at Embassies, transportation, holidays, incorrect or incomplete documentation, or any other cause beyond Travcour’s reasonable control. Travcour will not be responsible for any consequences should the visa not be issued on time or declined. The accuracy of the information supplied in a visa application is the sole responsibility of the applicant.
In the event a visa application is declined, no Travcour processing fee will be refunded, only money recovered from the Embassy will be refunded. Travcour will not be responsible for Embassy errors. While every effort will be made to ensure the visa/passport has been issued correctly, it is the client’s responsibility to ensure the visa/passport has been issued correctly and in accordance with their travel plans. Travcour reserves the right to on charge the Consular fee as requested by the Embassy on the day the visa is issued, plus any applicable associated bank fees. Travcour reserves the right to refuse to handle any application at its discretion.
In the event that a visa is not granted or processed in time due to some act or omission on the part of Travcour, Travcour’s maximum liability shall be to refund in full all Consular and /or Travcour fees paid to process the said visa.
In the event of loss or damage to passport(s) and supporting documents whilst in Travcour’s possession the liability of Travcour shall not exceed the actual replacement cost of the passport(s) concerned.
Travcour accepts no liability for passports and or documents received in a damaged state and it is accepted that documents have been received in said condition. Travcour will not be responsible for passports/documents that are misplaced/damaged/delayed/destroyed by an Embassy, Passport Office or any other third party utilized or for items that were not requested to be supplied.
Travcour shall be entitled to make additional charges for expedited services required in order to meet a traveller’s intended date of travel such as Embassy urgent fees, express couriers, exceptional communication costs and or waiting times at an Embassy.
Travcour will not be liable for any loss/delay/damage of documents upon dispatch on completion of transaction.
